What To Do After A Traffic Accident? Your Injury Attorney Explains:

Ohio Car Accident Injury Lawyer - Cleveland Traffic Accident Injury Attorneys – Call The Right Attorney - Cleveland, Ohio

Most people do not have the experience of being in prior traffic accidents or the knowledge of the best car accident attorneys.  So when a car accident happens, we usually do not know what to do.  Despite our best efforts, we might forget what really should be done at the scene of the accident.  At The Spitz Law Firm, your injury attorney understands what it feels like to be in that situation.  To that end, below is a helpful list of things to do at a car accident scene:

1. Stop Immediately: Stay calm and stop your car immediately. Don’t leave the scene of any auto accident in which you or your car was involved, even if the impact is slight. Unless the impact is extremely minor, do not move the cars. It will be important for the police to be able to document where and how the accident happened.  This information may be crucial for your personal injury case and cannot be created after the fact by your personal injury attorney.

2. Take A Moment: Take a minute to catch your breath and let your heart rate slow down. Check yourself for injuries. Often the initial excitement and adrenalin rush will prevent you from noticing normally apparent injuries, even broken bones or significant lacerations. If you have serious injury or feel light-headed or dizzy, do not get out your car as you might be placing yourself into greater danger. If at any point your start to feel injured, feel light-headed or dizzy, you should find someplace to sit or lie down away from the flow of traffic.

3. Check To See If Anyone Is Injured: If you are able to get out of your car after the traffic accident, try to assist anyone who has been hurt, including providing any medical attention you are capable of as soon as possible. If you are on the highway or high traffic street and you feel it is too dangerous to get out of your car, it is best to stay inside and wait for the police and EMS to arrive.

4. Call The Police And EMS: Every traffic accident should be reported to the proper authorities. The report may not only be helpful if you determine that you are injured or there is damage to your car, but it may also be helpful later if the other person tries to avoid responsibility for the accident. Injuries from auto accidents sometimes do not become apparent until many hours or days after the accident. You cannot go back in time to have a police report made no matter how good your personal injury attorney is.

5. Take Photographs: The mantra of the best personal injury attorneys is always to take pictures.  It is important to document the accident scene and the people at it. Take as many pictures of all the automobiles from as many different angles as possible. Take pictures of other drivers involved in the accident, particularly if they appear intoxicated or otherwise impaired. If you have immediately visible injuries, such deformed fractures, lacerations, or bleeding – take photographs of those injuries. These pictures will be important pieces of evidence in establishing the value of your case. If you do not have a camera, remember that many cellular phones now have the ability to take pictures and short video clips. Getting this evidence into the hands of your personal injury attorney may end up being the key to your car accident case.

6. Collect Information: Initially, get the name, address, phone number, insurance provider and policy number, and driver’s license number of the other drivers involved. If possible get the names, addresses and phone numbers of witnesses that witnessed the collision. Make a mental note of what each witnesses say, such as “That guy swerved for no reason” or “She was driving really fast and dangerously.” As soon as you have the opportunity, write down these comments. If a witness leaves the scene, you should make a note of his or her vehicle’s license plate number. Law officials can trace the owner’s name and address.  This information will be extremely helpful when your personal injury attorney is preparing and developing your injury claim.

7. Inform Your Insurance Company: Call your insurance company to report the accident. In some instances, not reporting the accident immediately can in the insurance company not covering you for the accident. When you call, be sure to ask the company to start paying your bills. This action should open up a file to not only pay the property damage but also all of your medical bills if you are injured.

Delaying Only Helps The Insurance Companies.

8. Cooperate With The Police: Give the police as complete a description of the accident as possible. Do not try to improve your claim by exaggerating facts as this usually backfires. As part of your information gathering write down the names and badge numbers of any law officer who came to the accident scene. Ask the officer where and when you can get a copy of the accident report.

9. Beware Of Insurance Representatives At The Scene: Some insurance companies send adjustors to accident scenes. These adjusters can to catch victims off guard with tricky, misleading or ambiguous questions. Under the pressure and stress of the situation, adjusters may ask victims to accept quick settlements or have them sign away any rights they may have to future compensation before they have the opportunity to speak with a car accident injury attorney. You have no obligation – and should refuse – to talk with insurance adjusters at the scene or at any time thereafter.
